Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
- Cooling-off period: the period during which the consumer may exercise their right of withdrawal;
- Consumer: a natural person who is not acting for purposes related to their trade, business, craft, or profession and who enters into a distance contract with the merchant;
- Long-term agreement: a distance contract relating to a series of products and/or services, for which the delivery and/or purchase obligations are spread over time;
- Right of withdrawal: the consumer’s option to cancel the distance contract within the cooling-off period;
- Merchant: the natural or legal person who offers products and/or services to consumers by means of distance selling;
- Distance contract: an agreement concluded between the merchant and the consumer using one or more means of distance communication;
- CESOP: the Central Electronic System of Payment Information introduced by the European Union to monitor payment service providers.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by the merchant and to every distance contract concluded between the merchant and the consumer. Before the contract is concluded, these Terms and Conditions will be made available to the consumer electronically or by other means.
Article 4 – The Offer
- All offers are non-binding. The merchant reserves the right to change or modify offers.
- The offer will clearly state the total costs, including shipping charges, import duties, and any additional fees charged by postal or courier services.
Article 5 – The Agreement
The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions set out therein. The merchant will confirm acceptance without delay by email.
Article 6 – Right of Withdrawal
- The consumer has the right to withdraw from the agreement within 14 days of receiving the product, without stating any reason.
- Return shipping costs are the responsibility of the consumer when the right of withdrawal is exercised.
Article 7 – Costs in Case of Withdrawal
The merchant will refund the payments received within 14 days after withdrawal, provided the product is returned in its original condition.
Article 8 – Customs, Import Duties, and VAT Obligations
8.1
All goods offered and sold through this website are shipped under the delivery term Delivered Duty Unpaid (DDU), as defined in Incoterms 2000. This means that the customer is solely and fully responsible for all costs and obligations arising from the importation of the goods into the destination country.
8.2
These obligations include, but are not limited to:
(a) payment of import duties, value-added tax (VAT) or goods and services tax (GST), and any other taxes or fees applicable upon entry;
(b) customs clearance costs, including any brokerage, inspection, or handling fees charged by customs authorities, postal carriers, or courier services; and
(c) compliance with local laws, product regulations, restrictions, and required certifications in the destination country.
8.3
The seller (hereinafter: the “merchant”) does not act as the importer of record for any order. Legal title to and responsibility for the goods passes to the customer at the time of shipment. The merchant is not liable for delays, seizures, refusals, or fines resulting from the customer’s failure to comply with applicable import laws or failure to pay required charges.
8.4
The merchant will provide the necessary commercial documentation for international shipping, including, where required, a pro forma or commercial invoice, product description, and declared value. However, the merchant does not guarantee that such documentation or the goods themselves comply with specific legal or technical import requirements in the destination country. The customer is solely responsible for verifying whether the ordered goods may be imported, are restricted, or require special permits or licenses.
8.5
The customer agrees to indemnify and hold the merchant harmless from any financial consequences, claims, penalties, or costs imposed by customs authorities or third parties as a result of the customer’s failure to comply with applicable import regulations.
8.6
Customers are strongly advised to contact their local customs authority or consult the relevant import guidelines before placing an order in order to avoid unexpected charges, delays, or border refusals.
Article 9 – Compliance with CESOP
As of 2024, payment service providers are required to record transaction data in the CESOP system (Central Electronic System of Payment Information) in accordance with European Union regulations. The merchant complies with these regulations, which may affect the monitoring and reporting of payments.
Article 10 – Conformity and Warranty
- The merchant guarantees that the products conform to the agreement and to applicable legal requirements.
- Complaints regarding defects must be submitted in writing within 14 days.
- Products must be returned in their original packaging and original condition.
Article 11 – Delivery
- Orders will be delivered within 30 days, unless otherwise agreed.
- In the event of a delay, the merchant will inform the consumer within 14 days after the order date.
- Orders are shipped under terms in which the customer is the recipient and the responsible party for all import-related processes.
- The merchant will ensure that products are shipped in accordance with international shipping regulations, but is not responsible for delays or issues arising during customs clearance.
- Failure by the customer to comply with import obligations does not constitute grounds for cancellation or refund of the order.
Article 12 – Complaints Procedure
- Complaints must be submitted in writing within 7 days after the issue has been discovered.
- The merchant will respond to complaints within 14 days. If a longer handling period is required, the merchant will provide an indication of the expected response time.
Article 13 – Disputes
These Terms and Conditions are governed by the laws of the United States. Disputes will preferably be resolved by mutual agreement. If necessary, disputes will be submitted to the competent court in the United States.
